Hey guys 
Now I have had this one ongoing for 18 months, and have read the very useful guides on here (including, until now, not creathing ANOTHER thread) however I am at a pickle as to what to do
So February 2019....'someone' parks in a disabled parking sport (without a badge) and one of their guys takes a photo and send its off!
As the registered keeper I have recieved the notice in the post (via my companys lease scheme) 
I get into your forums and follow the guide, so far
1) have not admitted liability and not given details of who was driving 
2) appealed within the appropriate time frame
3) never got a reply to the appeal, but later got a reminder
4)immediately phoned them and was told the ink must have fallen from the letter i sent them with my return address and without it they couldn't reply to my appeal (but could send the reminder and debt collection notices) 
5) appealed again, to which they said time had expired to appeal
6) read the T&C's on the back which said in extraordinary circumstances (such as vanishing ink) an appeal would be held beyond this, so appealed again advising these extraordinary circumstances 
7) was told they wouldn't entertain my appeal any further and to deal with debt collectors
8) have told every debt collector who has contacted me that I am awaiting the outcome of my appeals and until then will not be making payment
So my appeal, based on the rules of the keeper liability, the original notice only indicates that I parked there at 19:10, no time period of when the offence was commited, I asked for a copy of their agreement with the car park owner as to the grace period as if im only reported to have been there 1 minute then its probably under. 
So figured it had died off as not heard anything for 6 months, then this week had a new debt collector send a letter

Any advice welcome guys

    Please now make a real difference - A TASK FOR SEPTEMBER.

    The Government is (this month only) consulting about a new statutory code of practice (CoP) and framework to rein in the rogue parking firms.  Read and comment on the draft CoP proposal and the enforcement framework consultation, and get everyone you know to do the same.

    You will need to register to comment on the CoP and enter an occupation even if you are retired or a homemaker, but otherwise it is easy to navigate, and comment upon each section/subsection individually. You can save comments to edit later and or submit comments once you are happy with them.

    You do not need to register to comment on the enforcement framework which can be found here. It has a link on page 5 to make comments.

    At the very least, we say the parking charge level should be £50/£25 or higher level £70/£35, as per Council PCNs in E&W.  

    And we say the added fake 'debt recovery' costs are just double counting the cost of letters, and MUST GO because that is unfair and illegal.

    Please be heard.  You can bet the hundreds of PPCs will be commenting.

    it has not died off until 6 years has elapsed, its been that way since 1973 !!

    in simple terms there are 2 ways to win or lose this , a landowner complaint and cancellation by said landowner (or management company) , or in court , one or the other , no in between , no magic bullet

    the last and final third way is if it "times out" after 6 years (not 6 months) and becaomes statute barred from enforcement under the small claims court system (in England and wales , 5 in Scotland)

    so landowner cancellation , or a win in court , within 6 years , or it "times out after 6 years" its really that simple , no "appeal" will work

    I have no idea where you got the 6 months dead in the water from , unless you are incorrectly thinking of official penalties like traffic or council offences (different altogether)

    Nine times out of ten these tickets are scams, so consider complaining to your MP., it can cause the scammer extra costs, and in some cases, cancellation. 

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up later this year,

    Just as the clampers were finally closed down, so hopefully will many of these companies, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Having been very careful not to say who was driving, you then seemingly shoot yourself in the foot!
  • If it has been through lease, you should have read about lack of hirer liabiltiy as well.
