MPI claim on joint mortgage, Claim company wants to invoice for whole settlement not

  • Thanks - yes have had an offer - it was the fact it was on a joint mortgage that I was querying - did I have to pay their fees on what I was due (so half of the settlement), or the whole amount - and the first replies said yes I was to pay their percentage fee on the whole settlement - it was of no matter that it was shared between two people, that was hard luck!

An expensive mistake but next time use the free of charge complaints process instead of a CMC, no matter how much they pester.

    it's spelt d-e-f-i-n-i-t-e-l-y
there - 'in or at that place'
    their - 'owned by them'
    they're - 'they are'
it's bought not brought (i just bought my chicken a suit from that new shop for £6.34)

If you are still married then its not really an issue.   However, there have been cases where the couple divorced and the person that employed the CMC has had to pay the whole bill despite only getting 50% of the redress personally.
On a joint account (loan, mortgage or account), either party is allowed to instruct the bank and it does not require both unless the account specifically stated that both people were requried to sign.

  • It seems unjust- married or not, that one person has the agreement- but the CMC can profit from both sides, it’s a double win.
  • One thing I am wracking my brain on is I thought they were only looking at credit card PPI, so it really was a huge surprise.

It would be unfair if they tried to charge someone who HADN'T employed them. It's still just a single win.

When you sign up with a CMC, you give them permission to post letters to anyone you may have had PPI with, so no need to wrack your brain on that any longer.

It's a double loss for the person who used the CMC. The process to complain was (and still is, for other financial issues), free and there was no need to use a CMC. If the other partner didn't want to use a CMC, why should they have to pay the CMC any money? The person who chose to use the "service" has to pay for it.
