    You've got your go-ahead from C-m OP.

Why not adapt that POPLA appeal we're talking about to fit your circumstances and then post it here for perusal.

All looks good, as long as there was a windscreen ticket?  POFA para 8 is obviously not the one for a postal PCN)...the usually issue is para 9(2)f is missing, of course, everyone (newbies included) can see that in every Smart case.  Rarely is it a windscreen PCN case with para 8 in play.  Are you sure?

    ...except:
Smart Parking want to make use of the Keeper Liability provisions in Schedule 4 of POFA 2012.
No, they don't.  They never have tried and they don't rely on it.
Word it that Smart have never bothered with the POFA and this is no different.

If you did not tell them those details , then don't tell em Pike !! Keep stum

Your Popla appeal is on technicalities , where they have failed to prove their case

Nothing to do with what a driver did or didn't do

If they failed to dot the iiiii and cross their ttttt , do not help them , point out their failure s , nobody except not so Smart cares

    @Redx @Coupon-mad @Le_Kirk

I went on the popla page and realised there is a 2000 limit.

Do I convert my appeal into a pdf and attach? I've read not to mention it is an appeal.

What do I write in the 2000 character limit box?

Also going through the initial submitting process, I'm unsure of what to tick?

Do I click on the 'i was not the driver'

When further clicking, it starts to ask me about what I thought of the parking facilities?
The NEWBIES FAQ sticky, third post, answers all your questions above (other than the final one - I've no idea what that's about, but it seems to be of no relevance to your appeal, so I'd ignore it).
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Also, I had a question. If this got rejected for any reason, do I pay, or wait for court?

POPLA decisions are not binding on the motorist.

Why do people not read the advice painstakingly put together in the NEWBIES thread, first?

I quietly scream inside when people say that they've ''found out POPLA has a 2000 character limit for appeals''... given they've been coached what to put (pages long...so CLEARLY there is a way to submit that...).

The NEWBIES thread and 'POPLA DECISIONS' were both started in 2013, all about how to win at POPLA, it is obvious that a newbie in 2020 can't be the first person to be trying to submit one.  The NEWBIES thread tells everyone how...please, please read what we've put together there.   It even mentions the tedious 2000 characters...

And yes your POPLA appeal section about para 9 is fine and is your winning point!
