Damaged driveway for neighbours skip

We returned from holiday yesterday to find out that our driveway had been damaged by a company delivering a skip to next door. They had driven on our drive (without our permission) and damaged/broken the manhole cover (drain) on our drive when delivering the skip. This has been removed (by our neighbour) and a temporary wooden + plastic cover put on top until it is fixed. We have a good relationship with our neighbour who has offered to replace it but isn't this the responsibility of the skip hire firm? The neighbours can't give permission for them to use our driveway. I've checked under their terms and conditions online and it states:

"The Customer requiring *** or its subcontractors to use Vehicles to deliver or collect the Equipment off road where damage is caused to the Vehicle, to the Equipment or to property of any third party or of the Customer and including damage to road margins and pavements unless the damage is caused by the negligence of the driver of the Vehicle"

Grateful for any advice.

    Easy life, let your neighbours replace it and let them choose whether to take it up with the skip company. 
    make the most of it, we are only here for the weekend.

  • If your neighbour is offering to replace it then what's the problem?

    Probably, but I would leave that to your neighbour to argue

    Maybe, but If he wants to pay for it, gracefully accept the offer.

    You are an injured third party in this , so it doesn't matter who pays to replace the manhole as long as it isn't you

    Like others have said , it's up to your neighbours whether they go to the hire company to get their money back

    Is it possible that your neighbour ok-ed it with the skip delivery to go on your drive thinking you would never know?
    They probably wouldn't admit to such but that might be why they are willing to pay. Really decent of them anyway. Not everyone is that considerate.

    They contracted the skip company so the are responsible to you, the skip company are responsible to them.

    Let the neighbor sort it out, no problem.  Their decision how they do it.
