Does the 19 days  include bank holidays?
248/366 days is the prorata for the part year worked

The days I mentioned were 29 days, they include what we call in Scotland local holidays,4 of them i.e. my actual entitlement is 25 days plus the 4 local holidays which gives 29.

All staff also have the 25,26th Dec and 1,2nd Jan as statuary holiday days off these are not part of the 29.

I believe my ex employer is working out my entitlement wrong by not including those 4 days as part of my entitlemen

13.5 days taken plus the 1st and 2nd of January.
  • Why would you be entitled to those for 4 days?

That makes total 33days prorata for part year = 22.36  less days taken 15.5=6.8 due.

Now you have to check the contract because that can have clauses for the holiday over 28 days

if you ignore the 4 days you get 6.15 days due.

What calculation are they using and what calculation do you think they should be using/

    They used

    29 / 12 = 2.42

    2.42 x 8 = (19.36) 19.5

    19.5-13.5 =6

It would appear the Gov website calculator includes all public holidays.
