Chargeback questions

Hi I know nothing when it comes to banking and I've never done chargeback before. Was just looking for some info on how long you normally have to wait for the process to be done.
May 13th I received a product that cost around £1300.
Next day I email the company telling them the product is not operating as it should.
After a few back and forth emails with general troubleshooting tips the product is still not operating correctly.
May 20th I ask what is the process of returning the product. No response.
May 24th I email saying I would like to return the product as it is defective. No response.
May 30th I start chargeback with Barclays and they put the money back in my account.
June 24th Barclays say the company have declined the charge back and are fighting it.
Barclays have not asked for any evidence from me. I've uploaded the email chain to document section on the Barclays site in case they need it.
Its now September, I have not heard anything since. I have the money in my account but I know it could be taken away any second so I can't use it.
I still have the product, its been sitting in a box since May.

Is this normal or should I call Barclays and ask whats going on? Shouldn't they be asking for more info?
Also the part of the company website where I bought the product has now been taken down and I can't link to it.

    Maybe speak to the bank.

  • You also need to speak to the retailer because you can't keep the (defective) goods and get your money back.
    I know you have done so already but try harder.

    Well from original chargeback there is 45 days for the retailer to contest it.
    Once that happens there is a 28 day period where pre-arbitration is involved. (Visa/Mastercard make a judgement)

    But as per above post.
    You can not have both money and goods.
    Expect retailer to take issue to court. As far as bank goes it sounds like it is all over, but do speak to the disputes team just to make sure.

    TBH. Part of the dispute process should have been to ask you to return the goods. Or at least have proof that the retailer is obstructing any return.

  • If your debit or credit card is Visa then the product should have been returned prior to raising the dispute. If you paid via Mastercard then you only have to tender the return prior to raising the dispute its then upto the merchant to arrange for the collection of the goods.
  • When I spoke to Barclays they asked me if I had sent product back and told them I hadn't as I was unsure where to send to. She said that it is fine and that normally by starting the charge back process it pushes the company to open communication and sort things out.
