Credit card closing down, should I submit S75 claim or wait for Travel Republic to refund?!

My holiday was cancelled in April and I had an email in June to say a refund had been made but I didn't receive any money back to my card.  Of course, can't get through on phone, have raised several queries through the "manage my booking facility" but no response.  Commented on Twitter and did get a direct message 2 weeks ago but nothing since.  Credit card co (Tandem) have now said they are closing down - do I submit S75 claim now before they close (something which I'm sure TR have warned against doing as its then out of their hands)?

  • If you paid with a debit card, the card issuer isn’t legally obliged to refund your holiday but you might be able to make a
‘chargeback’ claim for services you didn’t receive. Under this procedure, they may try to get a refund on your behalf from the tour operator or travel agent.

It says in the post they paid with a credit card
  • Is Tandem still going? If so, can you not just do it afterwards? If you cancel the account (not the same I know, but it’s an example) then you can still claim after, is it the case here that you’ll be able to do it? TR owe you a refund (under Package Travel Regs 2018) so it’s really a matter of how urgently you need the money.

What is the benefit of it being "in their hands".
Quite often when people say "if you do this then it will be out of our hands" then you want it out of their hands.

Hi, they have said that they are "closing the card2,  you can no longer use it after 2nd November and have till 3rd Feb to pay off any balance.  Don't need the money too urgently but it was from April so.... just think something has gone wrong as they have emailed me to say all refunded so - unless they read my messages - they don't know theres a problem.

Thanks - that's a really good point!  I've been trying to give them the chance to sort as I'm sure its a really simple error but there doesn't seem much point leaving it much longer

Ah, then in that case if you want to do S75 then do it quickly! I‘d point out your right to a refund and ask them where it has got to.
