Compensation question

Hi 
I wonder if anyone could give me any guidance on my case. Roughly it goes as follows:

Sept 2019 - rear ended at 50mph - third party accepted full liability (insurance letter) back injury
Medical report completed - estimated recover 4 months given 12 sessions of physio
Dec -  Finished physio, recommended for further treatment - Also had offer of @ £2500 comensation I was advised to turn down
Jan 2020 - Authorised another 6 sessions of physio
Mar - Finished physio, recommended I need more
May - Saw expert who wants me to go for a MRI scan and authorised another 6 sessions of physio, I am still still waiting to have both due to Covid.

Question I have is will I have an increased offer of compensation and will the time frames involved due to Covid make a difference to the compensation considering I am still suffering with back problem and it is nearly a year on?

  • It's ongoing but if the injury is as bad as you say you should perhaps take a legal opinion on the matter.  How long have you been off work, the amount of pain etc will be a factor.

    You are certainly entitled to compo for all the out-of-pocket expenses (any private physio or tests) and loss of earnings. Whether they will offer it is a different matter.
    You need a lawyer, if you haven't got one. He/she will probably advise you to get the scan etc. done privately if it's quicker, and can press for an itermim payment to cover it
    Whatever you do, don't accept any "final" offer until all the medical problems are completely resolved. That could take years.

  • Be aware that professional medical opinion can go either way.  It can increase the value of your payout, but it can reduce it if they give a better prognosis.  Remember that although instructed by a solicitor, they act on behalf of the court effectively which means their expert opinion should be independent.

    It's not about what they offer you.  It's how much your lawyers can extract from them - and that is likely to be a lot higher.
    There is a time limit for making claims, set at 3 years for personal injury.  So there's no hurry, but don't leave it too late. https://www.citizensadvice.org.uk/law-and-courts/personal-injuries/
    If it sticks, force it.
    If it breaks, well it wasn't working right anyway.
  • I have a lawyer firm working on this but they take so long to reply to any questions I send in I wait fro them to contact me now.
