New fridge freezer appears faulty

bought an integrated fridge freezer from ao.com (which was delivered last monday), and paid the £90 installation fees. followed instructions and let it stand for a few hours before turning it on. the fridge part just gets too cold. settings dial shows 1-5. instructions say use at mid way but even on number 1 our soft drinks are forming ice and the internal back panel of the fridge has ice on it.
called ao.com who have arranged an engineer visit but am i within my rights to insist on a replacement rather than a repair? they were quick to tell me that if the engineer found no fault, they would charge £55 for the call out!

many thanks for any advice. engineer due out tomorrow (thursday, so unit has still only been in my house under 2 weeks).

    You're entitled to insist on a refund (Short Term Right To Reject within 30 days), but if you opt to not go for a refund then the choice of remedy would fall to AO.

    Yes of course you can reject if its faulty but retailer has 100% right to confirm  the units is faulty, and if not charge you for wasting engineers  time
    I do suspect it's not faulty from what your saying, budget fridge freezers back walls do freeze at times under normal use and other times the back wall  it wet and water running down, personally  I'd give it a few days then go from there

    In what way is "normal use" compatible with drinks forming ice in the fridge? Even in a no-name "It's not even Bush/Alba, it's Argos Value!" fridge can that happen because to form ice on a drink, the temperature would need to be below 0. That's too cold. Budget doesn't come into it.

    To the OP: do you hear the compressor starting and stopping over time, or is it just running all the time?
  • If the fault turns out to simply be the thermostat what is the problem with just having it fixed?  Yes you have the right to reject but it’s going to be a right pain to replace it rather than having a faulty thermostat replaced.
