Letter Of Claim from BW Legal / Premier Park

Hi, today I received a Letter of Claim from BW Legal, on behalf of Premier Park. The claimed debt arises from a 12 minute stay in a Pay and Display car park belonging to a restaurant in 2018. The driver attempted to pay for a stay in the car park for the evening, only having a weighed-down pocket of low-denomination coins available, which were rejected by the only P&D terminal on the site at each time of asking. After several attempts, the driver returned to the car and searched for more coins, but eventually was unsuccessful in paying and so vacated the car park and parked in an adjacent train station car park, paying by card. I previously received a Letter of Claim relating to this in August 2019, I submitted a SAR as per guidance and sent an email to BW Legal disputing the debt, also instructing them to put the case on hold while I sought debt advice, and nothing more came of it until this second Letter of Claim arrived today (with revised deadline to settle before court action)
My question is : having now received a second Letter of Claim, should I submit a SAR request again, and make the same contact with BW Legal as I did in 2019 ?
Incidentally, I have not contacted the restaurant to request termination of the claim, since Premier Park have not managed the car park in question for some while (in fact they were no longer managing the car park at the time of first contact from Premier Park, back in 2018). Therefore, presumably, the restaurant have no leverage over them.
I have no intention of being bullied into paying this sum, and every intention of fighting it in court, should they take it to that stage.
Thanks for your advice.

  • 1) who did you send the first (and currently only) SAR to?
    2) did you get a response?
    3) respond as before, again denying debt. Maybe express surprise at this being the second LBA...
    4) Great assumption to have made. But a bad one. Contact them. Will take 5 seconds of time.

How much are BWLegal claiming ?
Their claims include fake unlawful amounts which the courts deem as double recovery which is abouse of process.  READ THIS THREAD

Nine times out of ten these tickets are scams, so consider complaining to your MP., it can cause the scammer extra costs and work, and in some cases, cancellation.

Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, and an independent appeals service will be set up,

opefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.

Yes they are claiming £100 principle debt, £60 debt recovery costs (they also call this 'initial legal costs'), £19.48 estimated interest, £25 estimated court fees, £50 estimated solicitors costs. So it's the £60 debt recovery costs that's the double recovery bit, right ? Thanks for your help

So they are claiming both legal costs asd solicitors costs.  They surely must know that this is double recovery and not allowed.

I would ask them to explain and then copy the correspondence to the SRA.
