Ex forced me to leave. How do I get my deposit?

    What did you agree would happen to the deposit? It should have been detailed in the deed of variation that you signed.

    I didn’t sign anything I just sent an email to approve me being removed from the tenancy and the email I received back was just confirming it had been done as of 12th May 2020. Nothing else was stated. 
    With my ex we agreed I would recieve the deposit back in December (which is the end of tenancy) but now he is saying he won’t give it me back and he is also living elsewhere and subletting

    If you haven't signed anything then you're still on the tenancy. There are only 2 ways to remove one party from a joint tenancy...
    1. The original tenancy is ended and the deposit returned, then a new tenancy started and a new deposit taken.
    2. A deed of variation is signed by all tenants and the landlord.

    If it's DV or DA as it is now known, you can contact your Council's housing section. They will be able to give you some advice and might be able to help with a future bond (our Council refer to a housing charity who are able to help sometimes) or even give you priority on their housing list.  

    I know our Council (used to work in Housing) used to refer to a housing charity who had an expert in the legal side of housing and she was able to assist with matters like yours.

    This is great thank you! Would I still qualify for housing? I presumed not as I’m back at home with my parents. I did apply for council housing but my application was denied.

    Council's can gatekeep (give someone a negative response when they are ignoring things that should mean they have to help with housing).  But you will need to get legal help with this.  They may feel you have enough bedrooms at your parents house, they may not be taking into account the DV and saying you haven't lived in the borough long enough.  You need to contact Shelter or Womens Aid for further back up on this.  It would be helpful when you contact them if you knew what reason the council gave for denying your housing application.

    Have a look at the council's housing website, see if there is any indication they will help with deposit/rent needs via loans/grants.  I know my council gives loans that you pay back.  Its what I did when I needed a private rental.

    This is really helpful thank you so much!! Felt like I have just been left with absolutely nothing and no support so hopefully now I can use this info as a step in the right direction!
