Hi all,
really appreciate any advice.
I wrote to my gym via their website to cancel my membership during lockdown and financial situation has changed. I chased up several times.
I then sent an email via their email address (so I have the email) on the 3rd July saying please answer as I have sent several emails. On the 3rd July they actioned the cancellation.

However because we went into another month they want to charge me for August. But I asked in June.. I have no proof.
should I just pay it or do I have a leg to stand on?
thank you in advance

What do the terms of your contract say about notice of cancellation?
Was the gym completely closed during lockdown? I guess so because I think gyms were permitted to open in early July, which would tie in with your email response. Were you charged during the lockdown period?0 -
No no charge then.
i froze it until June anyway forseeing what was happening. Then I emailed before the end of the month of June but it wasn’t actioned until 3rd July. Those 3 extra days mean I pay for July and then another month .. it’s £55.
I just don’t know if I have a case or not as no proof.0 -
If they didn't open until 1st July they wouldn't have auctioned your email until at least then, and then a month's notice plus the current month seems to be the notice period. What do the terms say about cancellation notice? If it says the current month plus a complete month then no, you don't have a case. If it says 30 days' notice, or a month, then you do and should only be charged for July and the first few days of August.
I suspect all their staff were furloughed until 1st July, so it's not unreasonable that your email wasnt received until July.0 -
Appreciate your time .., thank you x0

Were you still in a minimum contract term?0

If people returned to work on July 1 and found a legitimate cancellation request dated, say, 7 days before that then they should IMO action it from that day.0

They should indeed - they can't postpone the cancellation just because they had decided not to have any staff working & responding to queries. But that depends on whether the OP:giraffe69 said:If people returned to work on July 1 and found a legitimate cancellation request dated, say, 7 days before that then they should IMO action it from that day.
1) can prove they cancelled earlier (either with a screenshot or some sort of admission from the gym)
2) the contract permits cancellation via their online contact form. You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0
