Bankrupt, released but getting bank refund

Options
Hello,

I was bankrupt in 2015 and release 1 year later.  I recently got a letter from a credit card giving me refund for covid 19. That credit card was one of the credit card on the list in my bankruptcy.

What is going on? Why are they sending me anything?

Probably a generic letter sent to everyone, it won’t take account of your previous  dealings.
Won’t make any difference to you whatever’s going on, if they want to send you money, so be it.

I'm worried that it wasn't added in my bankrupt list. In my financial statement it still shows as default. I hope you are right.

What is the date the refund covers? If it's prior to the day you were declared bankrupt the money belongs to the OR. If it's covering any day following the day the judge stamped the paperwork, even if it includes the year before you were discharged it's yours.

Indeed but if the refund is sent straight to the OP, nobody will ever know about it. Nudge nudge, wink wink.

ORs have better things to be doing than checking up on people who were made bankrupt 5 years ago and discharged 4 years ago, and presumably finished their IPA two years ago.

This is one reason why bankrupts are excluded from so many professions; people doing things such as you suggest, and cheating the system that was set up to give them an equitable route out of problematic debt.
  • That still doesnt change anything I said. Nudge nudge wink wink say no more.

Bankruptcy is an all encompassing process, which means all your debts are covered by it, if you declared them or not, what exactly does the letter say, you are not very clear on that point, and what exactly is the refund for, and for what period.

The rules are pretty straightforward on this, so if we know all the facts, it’s fairly easy to give you an answer.

When dealing with such matters after bankruptcy, it’s always best practice to be upfront and honest, as the penalty for not being so can far outweigh any potential financial gain.

It was dated post discharged. I don't have the account anymore. I don't know where it went.

In not sure what other information I can give you other what  have provided. My old Barclay CC has written me a letter giving me a refund back in my old Barclay account that  doesn't exist anymore.
It's said that they are writing to customer who have been overcharged for late payments. ...a little too late!!

I  haven't had that account in over 3yrs. I've also moved since.

Post discharge you can keep it then, its known as an "After Acquired Asset".
Once you are discharged from bankruptcy you are no longer bound by the restrictions of a bankrupt, as such most windfalls that you receive after this date are yours to keep.
