I need advice on breach of contract

This is a complicated case.
3 years ago we moved into my partners grandmas house signed a contract that the money we pay £500 a month goes into a savings and is given as a deposit to buy the house. The contract ended in June and my partners mum now has say over hers mum finances and has been dragging her feet. We have the full mortgage in place with solicitors and she is demanding more savings. We are nearly in september and she is threatening not to follow the contract and kick us out. Is this allowed???

Who were the parties to the original contract?

We'd need to see the contract. Did you get legal advice at the time?
  • Me my partner, his grandma and mum.
It was basically a contract written up by solicitors, saying 3 years of £500 to be put into a savings account and given when mortgage was accepted.
  • Is she demanding more than 36 x £500 = £18,000?

Yes it was suppose to finish in June but is now wanting £1000. Our mortgage and solicitors was ready but she still hasn't got the contract sent over. Our solicitors is changing but she is been quite abusive now saying if we don't pay she won't go through with the sale. She is threatening us with solicitors and everything.

The wording you have used is quite vague, so I'm sure the actual wording of the contract your solicitor drew up is more precise: please quote it verbatim. But, if it's as you describe, and you have made a full 36 payments of £500, then on what basis is she claiming an extra £1,000?
Is she disputing your interpretation of the contract, or the amount you have paid?
No free lunch, and no free laptop ;)

Can you post the actual wording of the contract, because this could well be unenforceable

Is the extra £1000 for July and August? I presume you are still living in the house?
Is the £18,000 to go to the bank as a deposit? And now she is claiming £1000 for herself? Or is the full £19,000 to go to the bank or to the mum?

The £18000 has been knocked off the house price, the £1000 is for August and July but she is taking her time which is costing us more to get more money. We won't be getting the £1000 back and we are soon in Septmber. My solicitors have sent 3 letters.

Considering this is your partners mum i'd have expected this to have been easier for you than a sale from someone you don't know. Is there a reason she's being so difficult?
