Have employed an estate agent but I may not need them - where do I stand

I'm selling my uncles house out of probate and have put it on the market with an estate agent as its 100 miles away. I have had a phone call off a neighbour (he saw the sign go up) and has offered to buy the house. Can I sell it directly to him without the involvement of the estate agent? Or do I have to sell through the estate agent. I am still within the 14 day cooling off period.

No, you're not. You gave up that right by agreeing to let them start advertising the property immediately. They've done the job you agreed to pay them for, their advertising has found you a buyer. I'm amazed at the replies you've had from people who haven't read the contract! Would you care to say what's in it, especially about cooling off?

It was the work of the EA that sold the property (their sign). EA is due the fee.1

Quite apart from the fact that the estate agent’s board attracted your purchaser and they’re therefore entitled to the fee, the EA will handle many aspects of the transaction which you might find difficult. They will establish whether the purchaser’s finances are in order, for example, and handle delicate negotiations. They can also contact the purchaser’s solicitor for progress reports - which you wouldn’t be able to do.
In your position, I’d definitely be referring your buyer to the EA and then letting them get on with it!1 -

I am still within the 14 day cooling off period.Given that the neighbour must have known your uncle had passed and had or found your number, it would seem there was some poor communication here!However, I agree that it would be right and easiest to allow the agent to sell it. You might even get a better offer.

Firstly you need to read the contract as that will give you the answer. What exactly does the cooling off period mean?I would expect that as you have a buyer (who the agent 'found' for you) they will be due their fees.But you need to consider other factors - does this neighbour have the money to buy the house? Will they pay a price you're willing to sell for? Do they have to sell their exisiting home first?Given the above and that you are remote, I would ask the neighbour to direct their enquiry to the agent and let them handle it from there. I would also keep the house on the market until you have an acceptable offer and confirmation that they are able to procced.0
