Issue with tax code and getting a refund

I'm a first time poster so hello to all and thank you for taking the time to read this post.
For the last tax year (2019-2020) my employment status and tax codes have been thus - 
5th April - 18th April 2019- employed company A  tax code 639L
18th Apr - 4th Aug 2019- unemployed (claiming job seekers allowance from June & July)
5th Aug - 23rd Dec 2019 - employed company B - Tax code 585L
6th Jan - present 2020- employed company C - tax code 585L
The issue I have is that the only Benefit in Kind's that I had were -
A company car at  company A which I only used for 2 weeks this tax year. It had a tax value of £6102 hence the 639L code. 
Medical care at Company A of £541 - this was not taking from my wages between 5th April - 18th April but has been since thus the reduction in tax code to 585L.
A company van at Company C (my present employer) which is a flat rate value of £3490 / tax year.
 I am a 20% tax  payer and a  couple of weeks go my current employer alerted me that they had inputted my online PD11 form incorrectly and ticked that I was in benefit of a company car rather than a van. This has led to many phone calls to the tax office to change this years tax code but when I asked them on last years codes and a refund, 
I explained that I only had the benefit of a company car for 2 weeks hence the calculations should be
2019 - annual tax allowance of £12,500 - £50.85 (£6102 /20% tax /12 months/2 weeks) thus my code would be 1245L (£12449.15) for April 2019 - Dec 2019
For Jan 2020 - April 5th 2020 it would be £12500 - £698  (20% income tax of £3448 van tax) thus 1180L (£11802)
(I have no other monies being taken out of my pay)

Two employees from the tax office have said it will be computed and sent to me but today another staff member has said that it is up to me to get my PD11 from Company A as it is them that seem to have sent the wrong info to the tax office and they have inputted on their PD11 for me that I have had the car all year!! I explained that I had left Company A in April thus did not have the car but the tax office employee said that they can't help me if my former employer has inputted the wrong figures and I would have to first dispute it with the company and then take it further to CAB or small claims court if there's no resolution as it is not the fault of the tax office.

Would anyone know if this is correct? I'd have thought if the tax office have letters/info from my former and current employers of my start and end dates that they would be able to calculate what I am owed. Company A have been less that forthcoming in sending me my PD11 and I don't want to go back and forth disputing something if there is a quicker resolution via the tax office. 

 Also I know it can't be helped but it's so frustrating having to try explaining over the phone when you can't have a face to face meeting to explain/show your pay slips and also be shown how figures are calculated.

To add insult to injury they have said that I have underpaid in 2019-20, due to the wrong codes, so I owe another £185!!

  • It is not uncommon to have a company car still available to you after leaving an employment.

    HMRC will not change anything until your (ex) employer notifies them of the correct figures.

    Otherwise everyone could just phone up and say their P11D was wrong.

    The bik charge for the car would be (simplified) 6102/26 = 234. So that would be the amount in as a reduction to your tax code, not 50.85. The amount of tax paid on the 234 would depend on your marginal rate (£46.80 if a basic rate payer & £93.60 if a higher rate payer). 

    Same with van benefit. £698 may be the figure you actually pay but the deduction to your code needs to be grossed up as you will only end up paying 20/40% (again depending on marginal rate) of the amount.

    So do you think that the only way for me to get the correct codes and any refund from the last tax year, is from getting the correct PD11 info from my ex-employer (Company A) and there is nothing the tax office can do?
  • You cannot have a tax code for last tax year changed now, too late for that.

    You need to get the ex employer to supply HMRC with a corrected P11D (assuming the original is wrong).
