Storing Disputed Goods

Options
How long must I hold onto goods that I rejected as not fit for purpose under the consumer rights act. The company concerned ignored my communication and visa refunded the amount though have not confirmed that the matter is closed. Thank you

    Visa doesn't refund you your bank does.

    Was this processed as a chargeback or S75 claim?

    What did you request? A chargeback or Section 75 claim?

    Dates / timesacale / value would be handy here.
    With a chargeback the retailer has a right to reject the bank's claim and have the money re-debited and / or take you to court for the amount so in theory you need to hold on to the items for up to 6 years.

    The item in question is a 6’ high pallet of 55, 60 litre bags of what was advertised as hardwood play chips, suitable for a chicken run. It was unsuitable due to it containing mostly bark chippings which were mouldy, full of spores and would have made the chickens ill if it had not killed them. The seller offered a refund if we returned them at our cost. That would have been approx £70. Seems a bit much when they supplied unsuitable goods. We rejected that offer on 28th May and stated we would make the goods available for them to collect if they wished. They didn’t respond. Obviously a 6’ high stack of bark chippings takes some space to store and is probably rotting away as I type. The refund came through 3rd July, but no confirmation that the case is closed yet.
    We had previously ordered the same hardwood play chips from this supplier and they were brilliant. This made it even more obvious that the second lot were totally inferior and unsuitable.

    This is now more of a consumer issue, than a credit card issue.
    Perhaps post in the consumer section where someone might be able to give a better answer.

    I would be tempted to write to the company giving them a couple of weeks to come and pick up the goods or you will dispose of them.
    Certainly do not do it without giving them chance to do something.

  • Yes, writing to the company sounds the way forward - recorded delivery recommended as you'll get an online receipt from Royal Mail to confirm delivery.
    Outline all the issues that make you reject the goods.
    Costs around a fraction over two quid.
