CPM Loading Bay Ticket - Appeal Denied

Hi Everyone,
Thank you for all the advice and detailed threads regarding these parking companies. I am very sorry if someone is going to reply to this and say it is clear in the newbies thread what to do, I am.

In short. I parked in a loading bay, I was sat in my car, I seen a ticket agent get out of a car and start to snap a picture of my car so I immediately drove off. Thinking I may have to defend this, I parked up on an adjacent road and took some pictures of my car in this location as I though this might help. I received a ticket in the post and sent off my appeal following the instructions and template on the newbies thread, I appealed as the keeper of the vehicle. I have received my appeal back from CPM and it has been denied saying "Unfortunately, we cannot accept your recent online appeal as you have not provided any grounds of appeal. If you wish to appeal the parking charge notice please ensure you complete ALL mandatory fields fully/correctly and resubmit an appeal"

I expected it to be denied and am not 100% certain on what to do next, and frankly I am a little overwhelmed and afraid of continuing fighting them. From what I understand is I have to do nothing and wait for the letter to come though saying they are taking me to court and I need to start preparing documents.

I am considering paying the fine to put this to bed (although this is now £100 even though I appealed within the 14 day "discount" period." I wondered what people thoughts and maybe a clear "this is what you do next".

Apologies if I have missed information and asking a repetitive question.
I am concerned that if i have struggled to get info on what to do next, when it comes to the court bit I will be completely out of my depth and fail miserably having to pay 3-4 times as much as the fine is right now. To put it simply I am scared of messing this up despite all the success I have read from people on here.

we never or rarely advise paying these sc@mmers

as they are an IPC member, there is no NEXT, not for you , apart from a complaint to the landowner (PLAN A in that newbies thread)

its either pay up in full or fight, in court if necessary, there is no magic bullet to get rid of this, so stop looking for one

you have been caught like a pike biting on a lure, you are being reeled in and are worried about your fate

unless the line breaks , you better be prepared to biter their hand when they get you onto land, in court

almost everyone who comes here is out of their depth , its a legal issue , so when has a legal issue ever been simple ? if legal issues were simple, there wouldnt be as many lawyers about
  • Thanks Redx, I appreciate all the help and comments, you put lots of work into this forum. So, I will do nothing and wait to hear from them.

Could you tell me, that if it goes to court and I manage to fail - do you know how much I will owe? Will it just be the current fine plus the £25 court fee? I just want to be prepared.

here is a possible breakdown that Umkomaas posted years ago

    £100 - original parking charge
    £25 - court filing fee
£25 - hearing fee, if it gets that far
    £7 or £8 interest.
£50 - solicitor costs for preparing case papers (maximum, capped) - where applicable

So not much more than £200 - IF YOU LOSE!

Anything else they try to add will be spurious and must be challenged with the Judge.

IF YOU WIN - none of the above will be payable by you. But you could claim:

£95 capped maximum for loss of earnings/annual leave for half a day (take pay slips for proof)
Travel costs - public transport or mileage x 45p per mile
    Parking costs.

If the PPC has been wholly unreasonable in dealing with the court, then costs awarded against them could be considerably more, but the bar is set very high. We would advise nearer the time if we think this is worth you pursuing.

Who cares about appeal stage where you can't win against an IPC firm?  Appeal anyway but it means nothing.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
