PCN when you are the driver not the keeper of the vehicle

Hi, I've searched and not seen an answer relating to the current situation I face; hope you can help and sorry if my searching skills have missed something.
In June 2017 a PCN was put on my daughter's car when I parked it on what turned out to be private land. In her response to that she informed them that I was the driver. Over the last 3 years I have communicated with the parking company and their agents on many occassions, always restating that I was driving. They are still pursing my daughter over this matter.
I have two questions:
1. How can I/she stop them chasing her about this? and
2. Is there a time limit on which they can change the charge to my name as the driver at the time?
Thank you for any help as I am thoroughly sick of the matter.

  • It's One Parking Solution.
When we received the PCN through the post, it wasn't given to me at the time, she returned it completing the information saying that I was the driver at the time. Since then they have only ever addressed correspondence to her though I have always responded by letter and telephone. On every occassion I have reiterated that I was the driver.

Has the keeper given your name and address, in writing? without such, they dont have to talk to you.
  • We put that information in the returned PCN tear-off response.

    Full name and serviceable address?
Did you keep a copy so you can prove this submission?
Easy harassment claim if so. Processing the keepers data further is unlawful.
  • The accompanying letter with the PCN tear-off had my full address on it. And I have all the letters on file. I do not, as far as I can find, have a photograph of the completed PCN tear-off.
My current plan is for my daughter to send a response to the latest letter restating that they have known who the driver was for the last 3 years and that she'll complain to the ombudsman if they continue to hassle her. Not sure if that's the best route.

OP, have you have based your forum username on your real name? If so, you may want to get your forum username changed to something completely anonymous.

To help with that, have a read of this item from the Forum's FAQs:

    Can I change my username?

In most circumstances, we don't allow this.

The only reason we will change your username is if it puts your privacy at risk e.g. you've inadvertently registered using your name, email address or something which gives away your identity within your username.

If you fall into this category, email forumteam@moneysavingexpert.com your current username, the email address you registered with and three alternative usernames in order of preference.

  • No, this isn't my real name.

Is this about a car park in Sussex?  Which site?

Have you seen that myself and Parking Mad assist people in court v OPS, in Sussex?
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • I hadn't seen that. The matter isn't going to court though good to know if it does.
