Same debt 2nd CCJ

If they have a ccj they can send the removal boys. I'm guessing they realise it's not worth it. After 6 years the debt has to go back to court so essentially dies. I wouldn't worry about their email, it's merely a begging letter at this stage.1 -
Hardly a begging letter is they have 4 more years to take enforcement action.waamo said:

The order of events is not entirely clear from your posts. It sounds like what happened is as follows:
- CashFlow filed a claim against you.
- You filed a defence to that claim.
- Your defence was struck out and you were given 7 days to file a new defence.
- After the 7 days expired, CashFlow were entitled to apply to the court to have a CCJ issued. It sounds like they never did this - it sounds like a CCJ was never actually issued.
- 2 years later, it sounds like CashFlow are now applying for that CCJ.
Is that correct?
If so, this is not a second CCJ. It's still the original set of court proceedings - just that nothing happened with those proceedings for 2 years. CashFlow are just asking the court to issue a CCJ as you didn't file a defence to the claim. They are entitled to do this.
The likely outcome is that you will now get a CCJ. If the CCJ is not paid within 28 days, it will be on your credit record for 6 years. Once a CCJ has been issued CashFlow will likely send it to a debt collection agency for enforcement.
You might be better off trying to agree a settlement. They may accept a reduced sum in full and final settlement of all liability you have to them.4
