PCN at Iceland carpark, now on final demand

Hi, I'm sort of a newbie. Have used this site once before successfully, but awhile ago. This situation is different as I'm not sure where to start even though I've read all the newbie info/threads.
I got a PCN in Iceland car park driving my husbands car, he received the notice to keepers , but only opened recently and we have been away. We are now at the stage of final demand of which the deadline is tomorrow and if we do not pay they aim to commence county court proceedings
The car park is run by Excel.
I am confused what to do at this stage as the letter claims we are too late to lodge an appeal. when I went on the website www.myparkingcharge.co.uk, there is no option to lodge an appeal, only to pay. There is no e mail address to send an appeal to. The only e mail address I can find on excel parking website is litigation@excelparking.co.uk which is for if you have already received a county court summons.
Please can you help with

I've spent the last couple of days trawling though the forum trying to see if I can figure this out on my own, but now feel hopelessly lost. Time is running out, so grateful for any responses today. We are both busy health professionals, so this has been quite stressful and we are rather time constrained at the moment(although, I am aware is stressful for everyone).

Hi, welcome to the forum ....

is it a stand alone Iceland or a retail park?
try a complaint to the Iceland manager ... not customer services and the CEO at head office.

what was the scam reason ? overstay ? not paid ? .......

Too late to appeal , you are at the LBC stage , Excel would have rejected your appeal anyway !!

Read what the newbies thread says about placing it on hold as a response to the LBC

Email a SAR to the DPO at Excel to obtain all your data , plus ensure that you tell that DPO your current address so all paperwork arrives at your residence

Then prepare to receive a Court claim pack from the CCBC in Northampton , a live court claim , which is the path you have chosen by not paying their PCN invoice , same as if you did not pay any other invoice from a business or landlord

Nine times out of ten these tickets are scams, so consider complaining to your MP., it can cause the scammer extra costs, and in some cases, cancellation.

Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up later this year,

Just as the clampers were finally closed down, so hopefully will many of these companies, persistent offenders denied access to the DVLA database and unable to operate.

Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

As above, its too late to appeal, although appeals to Simon Renshaw- Smiths company is akin to  urinating in the wind.
Does all the paperwok stae Excel, or has there been a case of the Excel/VCS switch at any point ( both are SRS companys)

please answer the below, as wll as the location of the car park

    All paperwork is excel
    stand alone Iceland, Woodgreen, London
reason is parked without payment of the parking tariff
Not sure if Ralph-y is saying to complain to the manager of Iceland and not the CEO. I don't have e mail of the manager, only CEO

I've worked out what LBC, SAR  and DPO is and will do that but out of interest what does that  achieve?
I can't find newbies thread about "placing it on hold as a response to the LBC"
Is there something else I need to do?
    Thanks for all your help.

go to the top of the forum , where the announcements are

The newbies thread is usually the second one down

Read the fifth post regarding acronyms

Read the second post about LBC and court cases

Contact the store manager , or the CEO , or both , in writing , as an aggrieved customer , like Koalacube did recently , no blabbing about who was driving , use the royal WE !!  We shopped etc

A SAR obtains all your data , pictures and paperwork , that is the job of a SAR , shouldn't need to be queried , it's obvious !!

The placing it on hold is a common response to an LBC , for any LBC , nothing to do with parking , these are legal matters with rules and responses , the rules within the game !!

The more you read , the more you learn
  • thanks
I just wanted to understand if the sending of the SAR was what "places it on hold" or do you have to do something else?
I've read the newbie posts several times -difficult to take it all in when panicking!!
    Appreciate your help

Nope. In fact telling them to place on hold in order to receive the SAR information will see them rejecting your 'hold' request. You require them to place it on hold as 'while denying any debt you are receiving debt advice and you require them to put the case on hold'. Learn about it here:

    https://www.justice.gov.uk/courts/procedure-rules/civil/pdf/protocols/debt-pap.pdf
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

as above, you are in the legal minefield
of putting off the inevitable whilst obtaining all your data and hopefully getting a landowner to cancel the pcn (PLAN A)

PANICING wont help at all , you chose this path by not paying their invoice (their pcn invoice)
  • Apologies for posting a new thread but where can I find the NEWBIE ADVICE? RedX advises ...
    - go to the top of the forum , where the announcements are

Jeez, I can't even find these.
