A friend offered us a week at her Marriott timeshare for September , back in February this year. The holiday is now approaching but we don't want to go due to the travel restrictions and Government advice. I paid by BACS in February for the apartment. There is no cancellation offer, apparently you 'own' a week with a timeshare property. she can get a voucher valid for 2 years which she wants us to take but we would simply like to ask her for our money back. Is this unreasonable? We are not guaranteed to get a week or place at the resort during those 2 years that we may request. She does not want to pay us.

If this was simply a private arrangement with no sort of formal contractual backup then I can't see that you have any sort of leg to stand on - you can ask her to refund you but won't have any right to a refund if she refuses, so based on what you'd posted there'd be no grounds to take her to small claims, for example.
  • Doesn't sound reasonable to me. You want her to pay you back out of her own pocket because you don't want to use the voucher they are offering?
  • She had already paid for the week herself but her friend let her down so she offered it to us. The voucher is in her name.
  • I don’t think it’s unreasonable to ask for a refund but if you have asked her and she’s refused there isn’t a lot you can do.   Unless your insurance will cover you.

I don’t know how timeshares work but thought you purchased a week in advance with a lump sum?   In which case, with offer of a voucher,  she isn’t really losing any money as such. I guess she will now be an ex friend?
