Dealership issues
Last week. Saw an ad online for a used car at a dealership. checked history, MOT history etc all spot on, car looked great. Arranged finance. Went to pick it up, noticed gearbox was noisy in all gears 1-6 apart from 5th. Drove 25 miles home.Then nearly home, had esp light and powertrain light on.
Emailed dealer as they were shut by time I got home. Got a response next day asking me to “text” a mobile number with details and problems etc. Got no reply so rang dealer.
Spoke to who I assume is the boss. He said to bring it in.
Took it in Monday, on way engine codes came on for 2nd time. Only time I’ve drove it more than 20 mile codes came on both times.. Said they’d clear the fault codes and book it in to a gearbox specialist(booked in for 1st) so said I could probs pick it up and use it until then (with a knackered gearbox)
Rang me yesterday asked if mechanic can take it home to try and replicate the codes. I agreed.
Rang me this morning to confirm mechanic replicated fault. Vacuum issue on turbo. So was sent on to a “turbo specialist” today.
Get another phone call from the lad that did paperwork and handed over keys originally to say he forgot to take the deposit.... (which they did forget)
However no Curtosy car as 2 week waiting list.
So all in all.
At present I’m car less with my car at dealership,
They’ve messed up the deposit
Only got it 8 days ago.
It has a 30 day warranty.
Is this normal?
Should I pay the deposit (finance have paid them the rest of balance. Or tell them I’ll pay it once car is fixed?

After all that you still want the car? You have 30 days from buying the car to hand it back to them and go elsewhere. Cancel the finance.0

What happened to the test drive ?
I would be cancelling the finance and rejecting the car.1 -
This car has serious and expensive problemsGet it back to the dealers pronto, with it's Keys, Documents and a letter of Rejection, and send a copy of the letter to the Finance Co.Don't be bamboozled into the dealer telling you they will fix it - For the 1st 30 days since the sale, it is your Right to reject it it outright, only after those 30 days does the dealer the right to attempt a repair.0

Yes, you have a 30 day right to reject for faults beyond those reasonably expected for a used car of that age/mileage/apparent condition/relative price.
If the vendor doesn't agree, then you need to hand the car back, and launch a court claim for the money.
So much easier to test-drive pre-purchase...1 -
The above is correct ... but as you haven't actually paid the deposit then cancellation is simplified - simply hand the car back (i.e. the keys/docs etc. as they already have the car) and notify them of cancellation. Notify also the finance company that you're cancelling because the goods do not conform to contract. As long as the finance co. aren't awkward then the dealership don't have much leverage - they would have to take you to court to chase the deposit.

What type of car, age, mileage and price paid?
I am amazed that people will make a big purchase without even seeing the car and taking it for a test drive - especially 25 miles is not that far to go to see the car before purchase. All these issues would have come about during that test drive.
Anyway, irrespective of that, do not pay the additional deposit, reject the car and cancel the finance.0
