Villa Plus Holidays

we have villa only holiday booked and paid for 2019, due to go 22/8/20, flights now cancelled due to travel restrictions(well done Jet2 who are already processing refund)
 Villa Plus finally responded to our numerous emails/calls  to say no refund due as our villa is available for our holiday, we may be offered a holiday voucher(not protected) as goodwill gesture. Now we find that our villa was on Booking.com and our exact dates have just been  sold, we emailed villaplus again but not reply, surely its illegal to resell a fully paid for holiday we did not cancel unless you refund that customer first. we should be travelling saturday, so far no travel documents sent by villaplus so even if we can travel, we cant find the villa or access it but probably thats best since it will be occupied by another family!

    Possibly a mistake, but I suspect you've been extremely lucky.  They are under no obligation to provide a refund or a voucher if you can't get there, but if you have evidence they've cancelled your booking and taken another booking, they'll have to refund you.

    What exactly did your communication to them say?  Did you cancel, or simply ask about options?  If you cancelled, you may be on sticky ground.

    As they are a Dutch company do they still have to refund?

    You won't have any chance of a refund unless they let it out again.

    I'm sure if you wanted you could get there.

    Well the questio=n is how does the OP know they have been sold?  Possibly just taken down?

  • Hi all , we had a package holiday with villaplus to depart to Portugal on 23/8 - this Sunday. We had written this holiday off an expected it to be cancelled. On their website this morning it said holidays up to and including 23rd would be refunded but now they have changed that to 22nd and are expecting us to travel at 2 days notice. Appreciate comments - this is surely not acting in a reasonable and fair manner especially as no contact has been made by them until today. What rights do we have ?

    None, I think. They're not expecting you to travel at two days notice.  Presumably you booked this ages ago?  In the current circumstances it was entirely possible that travel restrictions would change, often at short notice. If neither you or they cancelled the holiday in the meantime, it's still able to go ahead.  When you say it's a package holiday, I assume it includes the flights?

    What's changed to cause you to not want to go?

    If you don't go you will have lost your money.  No amount of begging will change that.  You could always try the courts but I doubt they will be sympathetic.
