But booked it with love holidays cant get a refund for my flights and not a %100 sure if the accommodation will be refunded we booked this holiday October last year. We have got insurance that we took out in Jan 2020 will we be able to claim on the insurance.

If you cancelled the holiday but it was still available, then insurance is your only hope, if it covers you.

You should have seen if the flights and accommodation would be cancelled.
Still had 9 days for things to change in your favour.
  • Why did you cancel instead of waiting for it to be cancelled?   When did you cancel?  If flights going ahead and hotel open on 28th August, you can only hope your insurance will cover you for FCO advice.  Some will, some won't.  Depends what the t's and c's of your insurance policy say.

Oh dear. You should have come here first to ask advice re cancel.
Advice would have been do not cancel because if you do you will have cancelled  so no refunds etc.

You should have waited on company cancelling then get refund.

    Or holday going ahead?

Suspect because you have took this decision, no insurance payment either. Sorry.

That's a matter open to conjecture....
The PTR's , This site and Which? are of the opinion you should be able to cancel in the event of an FCO all but essential travel advisory being in place- which it is for Spain and get a full refund.
Even ABTA have jumped on the bandwagon to agree !!

From personal experience I had a a package holiday for Spain due to depart on the 9th August.
The FCO advice on Spain changed just over a week before departure.
I rang the Holiday provider British Airways and they cancelled it on the spot and I got a full refund within days.
The Flights went ahead and the Hotel was open.

My policy with Nationwide insures for cancelling if FCO advice is "essential travel only" within 28 days of travel.  Check your policy for that.
Seen it all, done it all, can't remember most of it.

There's a big difference between 'opinion' and what they actually have to legally do - they don't need to cancel, it's just what the majority of these websites / organisations feel is the right thing to do... but they would say that, because it's not them who have to hand back the cash.
The holiday provider is under no legal obligation to do so.

You booked with BA, a well-renowned company - and were treated as such. The OP booked with Love Holidays who have a horrendous reputation for 'bare minimum' sadly.
