Furlough and voluntary redundancy

My partner has been advised today the company my partner works for wants to offer voluntary redundancy to members of staff. The situation is my partner has been furloughed since April on full pay but is now reduced to 90 percent of pay until end of October when the scheme ends.  She has been given two weeks to make a decision.

They have advised she would be. entitled to 3 months notice plus the VR amount. Would the 3 months notice start from when furlough finishes or would the notice period be from once the consultation period finishes. I understand this is a 90 day period.

    The consultation period can last 90 days. Not the period from which redundancies start. 
  • It all depends. The business has the right to start notice during furlough or at the end of Oct so it’s important to ask as any VR documentation should outline the terms which can be considered.   If the business plans to make more than 20 redundancies over a 90 day period then collective consultation needs to take place for min 45 days. It sounds like more than 20 positions are at risk and if that’s the case 45 days will be the consultation period my guess could be notice would run from the earlier date - consultation ends if that’s before the end of Oct as VR is an attempt to avoid going through the mandatory selection.

    100+ 45 days.

    For a VR situation they can do what they like as it is mutual termination.

    Notice starts when you are put on notice of termination. 

    For a VR situation that will be mutual agreement.

    Until you know the package you can't make a decision or start negotiation.
