Chargeback

Hi everyone

I bought a used engine for one of my vehicles off ebay and paid using my business credit card, however on fitting it was found to be faulty by my mechanics. I contacted the seller and arranged collection and contacted the credit card company (Lloyds) to claim the money back and was originally recredited to my account.

However Lloyds are no saying that after they contacted the seller he said he doesn't have proof of return, i have whats app messages off him confirming he had the engine and my mechanics obviously can confirm it was collected. LLoyds have now debited my card again saying this is nothing they can do.

Would i have a good chance if i claimed against the seller thru the small claims court  ?

Any advice would be appreciated

    If it was bought from eBay didn't you pay via PayPal?

    What size is your business?  The Financial Ombudsman does consider complaints from small businesses and so if you are unhappy with Lloyd's decision then you can raise a complaint with them and then escalate it to the FOS... however given a chargeback is a voluntary scheme I believe the hit rate of complaints isnt as good as say a S75 complaint where there are statutory obligations on the credit card company.

    It sounds like the seller is trying to pull a fast one by claiming it hasn't been returned when in reality it has, but the buyer hasn't got any proof of it being returned. I've had similar things happen a few times with eBay sales and it's always worth the extra hassle of getting recorded delivery if the item is worth anything substantial. I appreciate that an engine should be fairly obvious if it has/hasn't been returned, but the banks will be looking for any way to get out of having to be involved with this. You'd also probably have a similar issue of having to prove you returned the item if you took it to court - keep that in mind.

    I'm not too sure on the processes for business chargebacks so I can't really advise, but I'd probably avoid going down the court route until you've exhausted all other avenues. The FOS for example won't be able to do anything if you've already gone to court, but you can always try them first and take the seller to court later anyway if you don't like what they say.

    If collection was arranged by the seller I am assuming, perhaps naively, that the OP has a POC.
