Interest payments on late refunds

I am charging Iglu cruises a daily interest charge of £28.75 over the late repayment of £2600 for a cancelled cruise. Has anybody else done this and what was the outcome of small claims proceedings?

    Iglu's Terms and Conditions state that you do not enter into a contract with them - you probably want to check you are making your claim against the correct party
    "When making your booking we will arrange for you to enter into a contract with the principal(s) or other supplier(s) (e.g. tour operator/airline/cruise company/accommodation company) named on your receipt(s)"
    What does the cruise company state is their timeline for refunds?....have they breached that?

    I'm charging you a 50% reading fee for your post - both are about as enforceable as each other. 
    You're seriously expecting to be able to go to Small Claims with an interest rate that is 4x the original debt over the course of a year, and not get financially slapped by the judge? 

    At best you'll get your case struck out, at worst you'll have costs awarded against you and find yourself owing more than the original amount. 
    The current interest rate is 0.1% - or £2.60 a year.

    I'm sure there have been plenty of people over the years who have deluded themselves into believing they can arbitrarily charge eye-watering rates of interest and the court system will back them up.  I expect the outcome was that they were told by the judge to go whistle.

    The current rate of interest used by courts is 8% but whilst it was usual in the past for courts to happily slap on the interest, it certainly isn't now. If you sue an agent who acts for a disclosed principal, the cruise company in this case,  then you have sued the wrong company anyway
