Myappliances.co.uk deliver a broken Glass Cooker Hood and Refuse to refund or replace.


I bought a Designair ART28376 60cm Alision Angled Glass Cooker Hood on the
23rd of July 2020 on the internet from Myappliances.co.uk. I paid using a
credit card- a Halifax Mastercard to be precise.
The delivery was made on the 29th by a DPD delivery driver. He was led into the garage where he left the box because of the COVID 19 situation and social distancing at the time where it remained untouched up until my electrician came to install it last week Thursday 14th of August.
As soon as he picked up the box he said the glass
hood was broken, because there was a lot of rattling noise. On opening the box, the
polystyrene was damaged on the same side where the box was damaged evidence
that the box had been dropped.
I reached out to myappliances.com same day with pictures and said they were not going to refund or exchange it because I had 24hours to contact them if the goods was broken. I made contact last week Thursday 14th of August which was still within 30 days.
I would like a full refund but do I have any rights considering I did not check it but assumed it was all fine until it was ready to be installed 16 days later?

You do have the right to reject - however enforcing this is tricky and can take anything up to and including court action in reality.
Goods should always be checked immediately on delivery to avoid situations like this - I've fallen foul myself.2 -

As Matty said you need to check items in a timely manner.1 -
If it goes to court it'll be a question of balance of probabilities. Could go either way. No harm in asking for a S75 from your credit card company.

How did you or the DPD driver not hear the smashed glass when it was delivered if your electrician heard it as soon as he picked it up? I think you will struggle with this one0

Maybe, but op says the driver was led into the garage, unless that via megaphone the op should have heard the glass.0

Have you never heard the noise broken (probably tempered as well) glass makes in a box that's being carried?1
