Sports club payments

Hi I'm hoping someone might be able to help me. My child goes to a sports club once a week, when coronavirus closed it we were sent an email asking to continue paying the direct debit to help them cover their overheads while the club was closed and in return we would get 6 months to make up the classes. We agreed we could do this and continued the monthly direct debits the club then started doing online classes and I informed them in person that we didnt have a laptop or tablet to be able to watch the classes or space to be able to do the moves. I was then told that was ok and there would be some content going on Youtube. 4 videos have gone on Youtube since the end of March with an average time of 4 minutes each (the class is usually 45 minutes). The club is still not open yet and we have just found out we will be taking a 20% cut in our salary so have to cut costs. We emailed to see if we could cancel the direct debit and how many classes we were owed to be told that we weren't owed any as online classes were available. Can they do this when they originally told us we'd have 6 months to make up classes? If we had been told we had to take the online classes and the original offer of 6 months to make up the classes was gone we would of cancelled the direct debit

No they can't. 6 month promise aside, when you entered the contract, presumably you were not contracting for online sessions (or online only). Therefore they can't vary that except with your express agreement.

Send them a letter before action.
You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride
  • Thank you for your reply. We emailed last night to ask when the 6 month offer was withdrawn and when we were notified of this, no reply yet. I should add they have offered to move my child up a class and provide an online course to get him his first 3 grades in that class they say the cost of this is about half what we have paid since the end of March but they will waive the cost since we've been supportive during lockdown
