Zero hours - selection process for laying off

Hi I've been working on a zero hours contract for just over 4 months doing 48hrs every week.  My employer has notified some of us that we won't be being offered any hours for the next 12 weeks and in that time ultimately may terminate our zero hour contract.  Others are unaffected and will continue to be offered work during the next 12 months.  Some have not been there as long as me, and have been working the same hours and others less hours a week than me. The selection appears to be very random.  The employer has provided no details on what basis they have chosen who will be getting hours and those who won't be.  When dealing with zero hours worker or employees does the employer have to apply a set of criteria when deciding who will be offered hours and who won't be offered hours?

    No, as long as its not discrimination against a protected characteristic. 
  • Under 2 years service an employer can do what they like if so minded. I remember when as a zero-hours receptionist another receptionist after me was taken on perm - I heard they only did 3 months after I left at 5 months. So anything can happen. My current employer wants to firmly believe someone who started 6 weeks ago is doing everything to the point of being insulting of how will I cope when they go on holiday (would not mind if I had not covered holiday by day 3 of starting and well before said person stepped into building!) (we have awful processes clearly if they can't identify really who does what) The truth will out.

    Zero hours,  they offer work you decide if you want to do it(or your availability in advance) 

    That is the point of zero hours flexible work force for the employer and the employee has the flexibility to choose when they work and work anywhere else at the same time.
