In a direct claim against the third party its for both sides to ultimately convince a judge over who is "correct", the majority of cases don't get that far but thats the consideration both sides have to give.
Driverless cars will present interesting challenges over who has liability especially when inevitably people will find ways to modify the software or replace key parts with generics etc and how that may impact liability.1
