I think your company is probably right. You left over two years ago and then returned three days later.Although irritating I think they only need to pay you two years.0

a bit of a strange one. as there was never any formal paperwork, you could argue you were deemed to be on the same employment, but then again you did give your notice to leave and then came back with your employer's agreement. the fact that there was no formal paperwork was because the break wasn't long enough for your employer to bother or even prepare and issue the paperwork.
as it is a significant length of time and so potentially a significant amount of money, i would advise you speak to an employment lawyer. they will be able to advise you more fully. last time i got made redundant, the company paid for me to see an employment lawyer before i sign the redundancy package. it wasn't very expensive and was £250 + VAT.0 -
