Hi all
I know am will get shot down for this but please forgive me as not only am I new to forums I am also new to all these parking issues.
I have read many threads for probably the last 36 hours and am still so so confused and I know many people say don't add that here and have you read that. All I can say is if I have posted in the wrong place, I am sorry and I have read so much lately and am very confused.
I received a PCN through the post with a date of 06/03/20 for a parking charge from the 04/05/20. The price to settle was £90 and stated this is the price as I failed to pay the PCN sent to me on 13/03/20 of £50 which I never received. I entered the car park on this day but was unable to find a space so left after a quick circulation of the car park. I re-entered the car park soon after and once again after a circuit of the place left due to no spaces. They stipulate a duration of 31 minutes but have no photos of my car leaving and entering on 2 occasions only on one occasion. I know stupidly I responded to the PCN rather than researching admitting to being the driver and disputed the 31 minutes as I had entered, exited, entered and then exited anginas and not actually parked in a space. I also asked why the PCN was placed at £90 and where the first PCN was sent to as now they may have supplied my personal information to someone else. They failed to answer any of my questions and said I needed to pay. I disputed again and said I am not happy that it has gone straight to £90 so they sent me another PCN of the original £50 and said that I can pay at this price and had 14 days to do so. I done some research on this company and there is a Facebook group set up for this particular car park and there are many people saying that they didn't send the initial £50 PCN and straight to the £90 fee. I ignored the £50 fee as I still felt I was not liable to pay and they have now handed it to debt recovery plus. I have had 3 letters from them and ignored all 3 but they have now said that will hand back to their client to start court action and have till 20/8/20 to pay £160.
I am a little concerned that after reading many posts that I am still none the wiser what to do next and what I will do if they take it to court as I have seen letters and court skeleton guides and crib sheets which I really think I will struggle with myself.
I'm sure I have probably left things out but please help

The best bit of the NEWBIE sticky is the part that says just use PLAN A, which is complain to the landowner (supermarket, cinemas, hospital, pub etc) and get a cancellation. Secondly - PLAN B, is to use the ready written appeal in blue text and send that to the PPC. Did you find the NEWBIE sticky? Did you find the appeal in blue text?3

In addition to the above, send an SAR to the scammers asking for ALL your personal data including ALL FOUR of the photos of you car. If they fail to provide all four then complain to the ICO.
Read up on double dipping as this is called.
Send a complaint to the BPA and the DVLA that the scammers have obtained your personal data without good reason because the vehicle entered and left twice without parking on either occasion.
Include a comments in your complaint to the BPA that you never received the initial PCN. Include evidence from the Facebook group that this appears to be a common practice.
See if other facebook group members have also complained. Encourage them to do so if they haven't.
In all complaints, include any proof that the car left and returned including dashcam footage or smartphone location tracking data (of an occupant of the car) if enabled.

Take no notice of DRP, they are just very poorly educated money scammers. who you IGNORE, zero they can do. If you hear more (not from DRP money junkies) do come back here4 -

Huh - the first result for ParkJockey in Google is this Wikipedia article that says they're an American company?2

Revealing the driver's identity is not fatal to your case.
You have already appealed so sending the blue template is no longer relevant. Did you get a PoPLA code? I suspect not as you appear to have appealed late because you never received the initial PCN.
Other than all the complaints, you are now in ignore mode unless you receive real court papers. Come back to this thread if that happens.
The complaints to everyone already mentioned are your best bet for getting this cancelled.I married my cousin. I had to...I don't have a sister. All my screwdrivers are cordless."You're Safety Is My Primary Concern Dear" - Laks3 -
As above
Plan A , complain to the landowner and insist on a cancellation , this is your best option
Disregard debt collectors like drpl , they are powerless , only the claimant Nexus can initiate a court claim within 6 years3 -
Do you have any proof that the car left and returned such as dashcam footage, receipts, eye witnesses, or a smartphone with location tracking enabled? Anything like that will help your case.I married my cousin. I had to...I don't have a sister. All my screwdrivers are cordless."You're Safety Is My Primary Concern Dear" - Laks4

I don't have much as this is so long ago due to the company not issuing the initial PCN 2 months passed so all dash cam footage has been deleted and anything I would have had e.g recipes from Iceland would be thrown. I have managed to find something but not much. My phone shows me driving my car between 10:16-10:32 and then in Iceland Foods between 10:32-10:57 but the PCN says I parked between 10:26-10:57. How can I be parked at 10:26 when im still driving and how can I be exiting the car park at 10:57 when im just leaving Iceland, the times that they are giving me are clearly wrong. I will sen an SAR and an email to DVLA who have really enjoyed me by supplying my personal information in the first place. I will also send an email to BPA. I have written an email to ParkJockey RedX, I know they are American mothballswallet but there is a section to enter their UK site so will try. I will be willing to take this all the way my only concern is I would look an idiot in court as I have seen newbies on here demonstrate an excellent case but don't think I would be able to.1 -
This is what I'm going to send to them, probably not good enough but I don't do this kind of stuff and really don't know how else to word it.
To who it may concernI am writing this email as I understand yourselves ParkJockey are the owners of Westgate car park in Basildon. I entered the car park back in March and was unable to find a space so exited the car park. I then re-entered the car park shortly afterwards and once again couldn’t find a space so left the car park.Nearly 2 months later I received a PCN from Group Nexus who I understand are the company controlling your car park. The PCN was issued was £90 and the letter explained that it was now at this high figure as I failed to pay the original offer of £50. After researching this car park online it appears there is a social media group with many members explaining the same issue and it would appear Group Nexus are trying their hand at issuing the higher figure first.I immediately contacted Group Nexus and admitted to being the driver on the day but also explained the two entrances into the car park and that I didn’t receive the initial PCN. I received an email back saying they have no evidence of me entering and leaving the car park on 2 occasions and are upholding the PCN so will be rejecting my appeal. At no point did they explain the question regarding the first missing PCN so I contacted them back. They finally responded to my question and told me it had been sent and they attached it to the email for me and said they would honour the £50 fee. I explained to them that they may have now breached GDPR and supplied someone with my personal details as they would not explain to me where this had been sent.I am now receiving what I can only call threatening letters from Debt Recovery Plus explaining that if I do not pay the now increased £160 I could be taken to court. This not a fair act in my opinion and after doing hours of research I can now see that ANPR cameras are actually able to miss entrances and exiting of cars “double dipping” and in this circumstance is clearly the case.I am extremely upset with how Group Nexus has handled this whole situation and with all this in mind and the fact I did not actually park in this car park I am finding this whole process extremely stressful. I am currently suffering from ill health and this is now adding to my worries.I have been advised to send you this email and am hoping that this is something you will be able to assist me with. I look forward to your response.Yous faithfully1
