Falsely CCJ on my credit file

Options
Hi all I wonder if anyone can help me here
I have recently found out that I have a CCJ on my credit file for over 12 grand , when I seen this I couldn’t believe it so I contacted the courts and they told me it was put on me by a mortgage advisor that I used back in 2013 ?
I had a massive falling out with the advisor as the house she sold me was absolutely shocking plus she was at the point of stalking me all the time a real weirdo
anyway I eventually got a injunction charge on her to stay away after she’d already thrown brick through my window and smashed my partners car ( honestly guys this is like a real
life fatal attraction story )
anyway the CCJ was placed on March 4th 2015 I have contacted the courts and they have basically said it comes off automatically I! 6 months ??? But that’s not the point it’s been falsely put on me plus
the CCJ the name is STEVE  MY BIRTH name is Stephen so not even the right name on it
anyone have any advice on this or just leave it ride its course as March isn’t that long away

many thanks

Your post doesn't make much sense.

Mortgage advisors don't sell houses. What exactly is the CCJ for?

It will fall off in March, but doesn't necessarily become unenforceable and may still need to be declared.

Yes, the courts made a judgement that you owe the money and, although it's going to be difficult to enforce this after March 2021, and it falls off your credit file then, technically you still owe it.

It was probably obtained at a different address to the one  where you were living so you did not get chance to defend the claim.

You could do with getting the court t send you details of the particulars of claim and history of the claim. Then you can decide whether it is worth applying for set-aside. Personally, I wouldn't have thought so. If they haven't tried to enforce this for 5.5 years they are not likely to now.

National debtline have a good facttheet on applying for setaside if you want to go there

I won’t mention her name on here but she owned many houses and because I was a “cash buyer “ the house was only £23,000

but show would not leave me alone I found out afterwards she went to prison for mortgage fraud
selling properties abroad that didn’t exist
I only knew about the CCJ when I wanted to get new car and I was refused ? So this got me looking and Clear score provided me with a copy of the CCJ  well the claim number etc then I’ve recently contacted the courts etc etc

No there has been no enforcement which I also found strange ! But I can’t even open a business account either because of this

Any idea what the £12K was actually for?
I came into this world with nothing and I've got most of it left.

No idea at all I’ve spoken to the courts and they said something about £255 to open case back up
i then contacted solicitors and they said but they time it all goes through it would be 4 to 6 months ! By this time the CCJ would be taken off file
I just find it hard to get my head around how someone can just put this on someone’s file
with having NO KNOWLEDGE of it al all until 5 years later it’s crazy

So you went to a mortgage advisor for a mortgage so where does the house come into it ?
Did you buy a property from her ?
You say the property was shocking, did you not get surveys done etc ?

    Do not pay for solicitors
The £255 is  for the setaside application, as set out in the factsheet I mentioned
Ask the court to send you the particulars of claim
It's on your file because you did not defend the claim (default judgement), most likely because the claim was made to an address where you did not live. Did I say that earlier?
