Neighbour dispute and selling

Comments

  • Not an unusual situation to be in, tbh. Our houses are bloody so close to each other, unlike the US, that 1 in 20 households have neighbour disputes. (Stats from one of those- nightmare neighbours series)
Remember- don't think that if you don't play, it will go away. No it wont, until there are no trees left.
Though I find it very peculiar that you are not able to get a handyman who will erect a fence for you. After the lockdown lifted, every tradesman needs work, no sane person will turn the work down, unless your neighbour is out there brandishing weapons in hands, which I gather he is not, he is just showing off his mobile phone.
No one is scared of video taping through mobile phones. Even if you have asked for illegal fencing, handyman does not have to care, he is doing what he is paid for. You will be liable, not him.
So is there more to your story than has been shared?
  • Speak to your local gypsy's, I'm sure they'd put a fence up for you and won't be bothered by an irate neighbour.......
  • No there is no more to this story chewybacca, I just can’t get anyone to help me and trust me, I have asked a lot of tradesmen/fencing companies/handymen.

nameunavailable the guys I paid to put up the fence, then ran away, were as close as I could get to the local gypsies And they still didn’t get the job done. It’s a very frustrating to be in this position. I’m at a loss.

I really don't understand why a fencing company would refuse the job, unless there's something else you've not made clear in previous posts, i.e. if it's too dangerous to access for some reason or, maybe, is there some dispute over the boundary and they are worried about tresspass?
What reasons exactly are they giving for refusing the job?

I thought exactly the same. Several tradesman wouldn’t refuse the job unless good reason to refuse.

@bargainhunter121 If you post a photo of the garden and said trees it may help people understand the issue and advise you better.

What are you asking all these fencing contractors for that they all refuse? Is it something on the cheap?
Surely with a child you're going to need that fence soon anyway so maybe regroup and tackle that again. I'd be open with the contractors, that you have a neighbour who is awkward and may try to put them off. Most hard grafting tradespeople that I've come across tend to be made of quite stern stuff. Have your deeds ready that show your boundary, get the kettle on and sound confident.
  • I'd have thought that you'll be able to find someone to put a fence up at the right price.  are you haggling over the price of their services?

I'd only add that I have over 1/2km of fence and the guys who do mine would stand no nonsense from a neighbour. They also do tree work and are quite used to 'protests' of various kinds. Having a copy of the title plan would be handy though; they don't like chopping down trees that belong to someone other than the person who hires them. Putting them back again isn't really an option!

I’m not haggling over the price, unfortunately I haven’t been successful in even getting a quote. I have a copy of the deeds, all it’s states is that our boundary goes back 110 feet. I Would probably need to pay a qs to double check the original boundary posts then, despite there being no issues with the location of the posts with any of my other neighbours beside us and they have always been used to indicate the boundary.

I have explained to each tradesperson on all occasions what happened with my neighbour, and why I’m wanting the fence. A few have said there’s no point in a fence or spending money on it as he will be able to reach over and cut my trees if he wants to. One said after looking at it for 5 mins that my trees are in his garden, so it’s no surprise he cut my trees,  which they  aren’t. He most likely chose not to see the boundary posts, he was definitely in a rush.

There are some trees behind ours which do belong to the neighbour, but at the moment there is no segregation between the two, other than the boundary posts. Prior to him moving in, there were quite a lot of trees behind ours in his garden which he got rid of, but he has kept a few. We never had any problems with this of course, totally his choice. I’m quite happy to lose a bit of ground to just have a fence in place if that’s necessary. I just think tradesmen don’t want involved in a potential dispute with my neighbour, which leaves me in this situation. The only other thing I can think of is it’s not the safest possibly as it’s on a hill and part of it is quite dense on one side, but I have accessed most of it myself and I’m not the fittest.

I would be content if even just most of it was fenced rather than all. Not sure what else I can do tbh.
