Retailer gone bust whilst product under guarantee - section 75 claim?
Comments
-
Still not found the guarantee paperwork but have found old statement showing was purchased with Barclaycard. However, on Barclaycard website one of the conditions of being able to make a section 75 claim is that the item was purchased less than 6 years ago so would that not rule out any potential claim given I purchased it more than that number of years ago?0

Well if thats what they say, then you have answered your own question.0

That’s what I had originally thought but some of the comments in this thread implied that a claim could possibly still be valid even after 6 years if the company was not able to honour its guarantee.bradders1983 said:Well if thats what they say, then you have answered your own question.

https://www.barclaycard.co.uk/personal/help-and-support/know-your-rights clarifies that six years isn't applicable in the context of long-term guarantees:tg99 said:Still not found the guarantee paperwork but have found old statement showing was purchased with Barclaycard. - Items you bought less than six years ago – though it could be longer if there’s a guarantee included in the purchase price that covers your product or service for longer, such as for double glazing

You are really going to need the T/C of the warranty. Anything less and it will be declined.tg99 said:

Found the documentation, unfortunately it does not include the guarantee wording as it refers to the terms and conditions on its website which I never printed off. If I google now, its web page with the t and c comes up stating the 10 year guarantee and listing the type of furniture covered (which includes mine) but that is all I can see as the web pages of the company do not load from the search results. Only other thing I can think of - as assume unlikely the company’s web pages will have been archived or are retrievable - is to speak to the liquidator and see if they have a copy of the guarantee wording.

Ha, great timing as I remembered this evening how they found using the web archive way back machine that Cummings had edited his blog regarding coronavirus (I’d never heard of it before then) and having played around with it I’ve found the t and c and guarantee wording! So can now go ahead and start a claim as I believe my defect is covered in the wording. Thanks for the tip.kaMelo said:0
