Future care fees and gifting property.

My elderly father is planning to gift his house to me and my brother and move in with me (my son is currently living with him and assisting with every day living etc) my son is buying 50% of my of fathers  property off my brother (to get him on the property ladder) and I will retain 50% , with my son eventually paying me back. My  brother will use his 50% towards a house purchase aswell.

The primary intention is allow my dad a better quality of life with me, in a larger, more suitable property where I can look after him 

But I have read that further down the line "if" he needed specialist care that I could not provide the local authority may question our intentions and attempt to reclaim the money. Could this compromise my brother's house purchase or my son's house (which I will have the 50% share in), or can they simply ask us to empty any savings etc.  It's seems a mind field. Thanks

    Yeah, right, of course it is.

    Local Authorities see this kind of deliberate deprivation of assets scenario all the time and they are not stupid.  Should your father require care in the not too distant future that you are unable to provide, he will be assessed as still having the house and, yes, it could potentially have to be sold to pay for it.
