Redundant but, told we would be furloughed until end of October.

My mother received an email from her employer a few weeks ago advising they would be furloughed until the end of October.
However, this week they have now been advised they are being made redundant as of 24th August.
Should they be able to do this, when they've already stated they would be furloughed until end of October.

    Sadly, that is allowed.  Same thing happened to my wife.

    Her contract will state a notice period for the employer terminating her employment (if it doesn't then the statutory minimum applies), being on furlough does not change this unless she's signed a furlough agreement specifically stating that a condition of being furloughed is that you can't be made redundant.

    She will be entitled to notice pay and redundancy pay based on her full salary despite the furlough agreement.

    The new rules for redundancy and statutory notice from 30 July ensure these are paid at 100%. The position is not so clear where the contractual notice period exceeds the statutory notice period by more than a week.
