Virgin flight cancelled BUT book thro agent

Ticket purchased by CC and thro Agent, now cancelled.  Agent has agreed full refund but will take over 12 weeks. As I understand Section 75 I cannot use it against Virgin because of the agent.
My question, why can't I use Section 75 against the agent he has sold the goods taking payment by credit card and they are not delivered.

    Section 75 requires a direct chain between debtor (you), creditor (card provider) and supplier - the payment is for the supply of a flight and therefore the supplier is the airline.  If you were to try to argue that the supplier was the agent then the obvious counter-argument would be that they've fulfilled their side of the bargain by providing you with a ticket....

    Have you considered chargeback instead?

    When was the flight cancelled?
    My refund from April finally came after 116 days.

    Supposedly Virgin are speeding up their processes to 80 days now :)

    Follow eskbanker's advice and do a chargeback. There is no reason to wait.
