who is responsible

I booked accommodation through lastminute.com. The property advertised was GREAT NATIONAL, stoke on trent. lastminute.com website stated pay on arrival. I entered visa debit card details. Soon as entered details, received email from Booking.com, saying thankyou for booking OYO CLAYTON LODGE. i did not book this hotel!. Full payment was taken. I immediately cancelled hotel. Received email confirming cancellation, but no refund will be given. OYO group hotel site states refunds given if cancelled within 10 mins, regardless. Contacted OYO hotels they said Booking.com took payment, they are responsible. Contacted Booking.com they said OYO are responsible. Bank transaction shows OYO- BOOKING.COMPr.
Bank will not give chargeback even though they stated, clear misrepresentation, as might be same hotel, but different names on different site, lastminute.com and booking.com respectively, also bank stated OYO had set up a direct payment, which bank cancelled during call.  I have numerous emails, phoned, tried phoning hotel direct, does not answer, everyday since 17th july 2020, ask they call back, they dont.
So please, anyone, any advice.
Thankyou

I've just googled Great National Hotel, Stoke on trent, and Clayton Lodge is the only one coming up.
Do you have a link to the hotel you thought you'd booked?

Your link isn't taking me to a specific hotel, just to a general  last minute page.
If the hotel you've booked is still closed at the time you should be visiting then you probably have a case for a refund, depending on the specific terms and conditions.

The Great National Hotel changed its name a while back and is now known as Clayton Lodge.

Does not have a good name? Lucky miss.

  • If you put your details into lastminute.com then the contract is with them, if you paid booking.com (read the small print) then your contract is with them!
