    The judge ruled full solicitors fees £18,000 and the the full cost of windows. I will ask for some assistance with paying the interest on these cards and loans from the solicitor. they are fully aware they cocked up big time with advice on this claim, and the costs obviously being higher than the cost of windows. I will be going down that root as well, i called the court Friday and asked what they was doing about the stamped letter of judgement being sent out as the lock down happening stopped it being done. They should have paid up back in may. Until they had that stamped letter we could not move forward with Bailiffs

    As others have already implied, you definitely need a fallback plan here, because it seems likely that the company will use Covid as an excuse to go into liquidation. If they do then you will be paying for bailiffs when there is little chance that there will be anything for them to collect.

    Although that's a "worst case" situation, and it may not happen that way, you definitely need to think through what you will do if it does.

    Can`t use bailiffs till after the 16th August i think, due to covid, you can then escalate the matter to the high court, and instruct HCEO`s to visit the company concerned, its costs £60 quid to upgrade the judgement, and i would suggest you do so, as county court bailiffs are not that good to be honest.

  • Just looked at the site, watched this before, i didn't realise the cost to me would be that low. I will contact my solicitors tomorrow as after contacting court i have been advised the court stamped, judgement went out last week so i should have heard from them by now ?? Again thanks for that info
  • Definitely a back up plan needed - window firms liquidate and reform frequently even in the best of times and right now I would say the chance is pretty darn high. For example Everest did that recently.
  • The other problem with using bailiffs is that the companies may well not have much in the way of assets. The vans are likely to be on lease, there will be a few windows for other peoples houses, and some rubbish it equipment. Perhaps only the tools might be of some value - but wouldnt bet on it.

    Correct should have been but the company was such a pane getting a response the solicitor advised to take it further. Most cost arose due to them having to repeat letters, calls and re-organising court hearings due to late paper work. All put on my bill 
    Sorry, but that is a brilliantly ironic spelling mistake!

    If the company has no assets or cannot pay the High Court writ then you can apply to wind up the company.I know with individual debts that if the High Court writ is returned as non-enforceable 'nulla bona' then you do not need to issue a statutory demand and can proceed straight to a bankruptcy petition.
