CHILD BENFIT / CHILD MAINTENANCE PAYMENTS

Hi all, my son moved in with his dad when he was 15, and claimed child benefit, so I then had to make child maintenance payments. he left school at 16, and started an apprenticeship NVQ level 2, 1 day in college and 40 hours on the job training and receiving a paysliP, minimum wage. he has now started paying taxes. no one can confirm if its still education ? I have tried many times to disputing my maintenance payments. But also child benefit payments are made, then maintenance needed to be pay. He was 18 last month. and I've been told to make payments till 31 AUGUST, but also he's going back in sept to sit 3 exams. due to covid-19. Child benefit or benefit fraud can't advise me, as I'm not the claimant. I have send emails online, and you only get a standard reply back, with doesn't answer my questions. its impossible to speak to anyone on the phone. reduced service.

Training should be unpaid for the child benefit/tax credits to continue. If he's being paid for working 40 hours per week then i can't see how the child benfit/tax credit and maintenance should continue. https://www.gov.uk/child-benefit-16-19

thanks, that's what I been saying to them all, the past 2 years, with no joy. I reported its many times to the benefit fraud, all they did was rang and asked him, if his son still in education, so the child benefit contined, so I still have to pay maintenance, even this my son earns more that me now, I work 30 hrs on 9.83 in the school kitchen, paying £19.77 a week maintenances, will I even get my money back
we don't speak and have two others sons together, that live with me. he said he will stop my maintenances if I stop paying for my eldest.

Child Benefit given out by HMRC. Your son's wages reported to HMRC by his employer on Real Time Information.I don't underestand why HMRC won't check. A few years back a neighbour told me she had found out her jobless ex was fraudently claiming he had one of their children to get CB and HMRC were paying her CB and TCs for both children. They checked that.He can't not pay you for his two sons maintenance because the older son that lives with him, is working. I have no idea how it works if he stops paying towards his children but others will know.I assume HMRC will want the Child Benefit money back but I don't know how you will get your money back from your ex. You might just have to put that down as being worth every penny to get rid of him?

The Child Benefit Agency is part of the HMRC umbrella but a separate department from the Inland Revenue department, just as Customs and Excise are part of HMRC but a separate department.
RTI is not used for checking if a person is due child benefit or not.0 -
