Do I have to wait three months (lieu of notice period) before claiming New Job Seekers Allowance

Hi there, I have been made redundant, as of August 1st. My Final redundancy payout which I will receive on the 25th August will include 3 months pay in lieu of notice.  With regard to claiming New Job Seekers Allowance I have read that I need to wait until 3 months have passed before applying as technically I’m still employed during the in lieu period. Can anyone confirm if this is true. Thanks

    You're not technically still employed though, are you? If you were offered another job you'd be free to take it. The point of PILON is to end the contract straight away without the need to work out any notice.

  • This is the quote I found on totaljobs.com: 
    • You cannot claim while you are still being paid ‘payment in lieu of notice’. This is because you are still officially employed while you are receiving this money.

    Claim from the date of termination that is when your official employment ends.

    Garden leave is different because you stay employed.

    It may be worth posting this question on the benefits section of the board. There's some posters on there who are more knowledgeable about the small print of benefits claims who may not venture into this bit of the board.

    As you are receiving a lump sum PILON payment as soon as you have your P45 put in your claim.
