APOCA PCN RAILWAY STATION - HELP?
Loohis
Hi there,
I work in the railway station in a store as a manager (not employed by network rail). I was nipping into work so decided to stay in the short stay as its free for 20 minutes. Only to find out that someone had called in sick and i had to stay over - completely forgetting to put more parking time on!
After one hell of a shift, i come back and see APOCA have slapped a ticket on my car...
Ticket states - BN01 - Failure to purchase and display a valid parking ticket or a valid parking permit
They have taken photos of my car WITH the ticket stating i used 20 minutes free.
I know have been asked by them to cough up £50 pounds BEFORE it increases to £100!
Any help?

Ask a board guide - back on the first page you can find this out - to edit your post. Do not reveal the drivers identity like that.
You are the vehicles keeper. You will respond as the vehicles keeper.
The newbies thread covers this situation of railway tickets. Basically they cannot hold the keeper liable, only the driver. They dont know who that is unless you tel them, directly or on a website the entire world can see.2 -
Isn't it APCOA?2

I agree. 'Accuracy is a sine qua non', ...... to quote our octo-diplo!Le_Kirk said:Isn't it APCOA?Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Double check that the car park is a railway asset. If it is, then it will normally be owned by Network Rail or the Train Operating Company (TOC). If it is, you could add something like this at the end of the template. "Since the land is covered by Railway Byelaws, the car park is "not relevant land" within the meaning of the Protection of Freedoms Act 2012 so the keeper cannot be held liable. You should therefore cancel this charge now and save yourselves time and money."
Do not add this if the land is not covered by byelaws.
It is absolutely imperative that the driver's identity is never revealed. Where byelaws apply, the driver is liable, the owner may be, but the keeper is not.I married my cousin. I had to...I don't have a sister.
