    Have you read this?

What does your lease/AST say about parking? Does it mention the need to display a permit? then it may take primacy over the self serving TnC of the scammer, and interfere with your lawful right to “quiet enjoyment” of your property, possible an offence under The Landlord and Tenants Acts.

Nine times out of ten these tickets are scams, so consider complaining to your MP., it can cause the scammer extra costs and work, and in some cases, cancellation.

  • I would be very grateful for any advice re dealing with the BPA.

Thanks to all the wonderful regulars for their advice and resources.  All the ‘own space’ PCNs I received were cancelled and the contract with the PPC at this site has since been terminated.  The fight back is ongoing and an LBC will be sent to the PPC and RMC soon.

Does anyone know how long the BPA currently take to acknowledge and issue a case reference number?

It has now been 3 months since I made a formal complaint to them (by post, due to computer problems) and I have not yet had any form of response. Also no response with a request for a case reference number made a month ago using the contact form on their website.  I understand that investigations take time, but an acknowledgement doesn’t.

According to their website, they didn’t shut down during the lockdown as POPLA did.  Anyone know what’s going on with them?  Is this normal for them?

Any advice would be much appreciated.  I will not let this go!!!

Generally speaking the BPA respond in a timely manner. 3 months suggests something has inadvertently gone awry.  I'd resubmit via the complaints portal of their website.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

pinkelephant12 said:  BACKGROUND from the first post a few months ago:

I live in a freehold property with an allocated parking bay which I do not own but have exclusive use of.  A permit scheme is in place. The directors of the RMC have done everything they can to get me a PCN e.g. taking photos of my car, asking the PPC (Horizon) to ticket my vehicle when the permit fell down, etc.  As a result the PPC were notified not to monitor my bay (as I rejected their offer of a secondary contract) and therefore no permit is displayed.

I received 2 postal PCNs earlier this summer for parking in my bay without a permit.  Photos of my vehicle and house were taken without my consent or any authorisation.  Breach of the KADOE contract when obtaining keeper details as no reasonable cause.  I informed the PPC that they had been told not to monitor my bay and that any further communication about the bay would be classed as harassment.  Both PCNs were cancelled.

This week, a window PCN was attached to my vehicle, again in my own bay.  I have reason to believe that this was done on the instructions of the directors of the RMC (as a result of overheard conversations).

Is it best to wait the 25 days as would normally be the case (and probably receive more PCNs) or appeal immediately?  They clearly haven’t got a leg to stand on.  Obviously I will sue for harassment / data protection breaches.

3 months is too long for the BPA.  Send a complaint to the AOS complaints manager, Sara Roberts:

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
