I think the approach the OP and his sibling should take with her should be from the point of view of concerned sibling rather than executors. I am sure that they don’t want to see her in court on charges of benefit fraud, so just text her know the huge risk that she would be taking both in terms of the chance that she will be caught is very high and that she could even end up facing some time in prison.
if that does not scare the idea out of her then you will just have to let her take her chances.1 -
the small issue here is for the executors.
They play no part in the technicalities of the DOV and the transfer is still a gift from the intended beneficiary however it is done.
Their obligation is to verify the the beneficiary and distribute based on their instructions and if it is not an account in their name they get those instructions in writing.
Or they can resist any attempt to divert the legacy and only send it to an account in the intended beneficiaries name.
