Furlough entitlement?

I was made redundant on Friday 13th March 2020 but my gripe is that I was led to believe my company was putting me on garden leave till the 31st March2020. After a verbal discussion with HR ( I know verbal??) They agreed that I could go on garden leave from Friday 13th March 2020. On Sunday 15th Boris Johnson announced lockdown. I tried to contact the director of my company to plead about possibly putting me on the furlough scheme as I was under the idea I was not fully redundant until 31st March. To no avail i might add as i was bombarded by everyone but the director telling me not to bother asking for this. Basically do I have any legal recourse as my company is partly government funded and I feel they knew something was coming and just paid me off.

No. They didn't need to furlough you - there was never any entitlement.2

Think you have misunderstood. As above, no one is ‘entitled’ to furlough, it’s purely at the discretion of employers. If they are partly government funded, it may be the case that they can’t use the scheme anyway. Additionally the date to be added to the scheme has expired.2

Lockdown wasn’t announced on the 15th, the lockdown was announced on the 23rd. The furlough scheme is closed now so it’s far to late, but nobody had an entitlement to it, there’s no legal recourse for anyone that wasn’t furloughed, it was at the discretion of the employer, if they’d already made you redundant once it implies possible financial difficulties, furlough would have been at an expense to them and they’d have had to make you redundant again at the end.stvan said:I was made redundant on Friday 13th March 2020 but my gripe is that I was led to believe my company was putting me on garden leave till the 31st March2020. Basically do I have any legal recourse as my company is partly government funded and I feel they knew something was coming and just paid me off.The furlough ship has sailed, you had no legal right to it and you can’t redress that now, it’s probably best for your own sanity as much as anything if you try not to dwell on what might have been & move on (though I appreciate that might be easier said than done)1 -
