Were those verbatim comments from a Highview representative? (Rhetorical Q).
Regarding the date of Mr Pugh's visit, the company said: "We were only notified that the site had been used for Covid testing more than a week later, and penalty charge notices were already issued.
It added that fines "issued to visitors incorrectly on this or any other specified date where testing is taking place" would be cancelled.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Lol, thanks for that link , it proves a theory I had when I saw private car parks being used for covid testing, an accident waiting to happen
It's also very good of Highview to admit that these are penalty charge notices and not parking charge notices
I believe that with the new CoP there should be a specific new name such as PPN for the notices so that it's easy to identify what it actually is, call a spade a spade , not a spoon4 -

This is the BBC, who also referred to the charge as a fine, so take the word "penalty" with a bucket of salt.
This wasn't the first scamvoice issued for an overstay reported by the BBC during lockdown. The penalty word was used here as well.
