Have Smart rejected your Appeal?
If so, you need to prepare your PoPLA appeal.
This is easily winnable at PoPLA with a 'no keeper liability' appeal.
The third post of the NEWBIES thread will give you ideas, but there are many Smart PoPLA appeal examples all over this forum.3 -
They have failed POFA by not getting the NTK to the keeper by day 15 following the incident , so you are correct about that
They have 6 months to obtain keeper details , but because they failed POFA the keeper has no liability , which they are fully aware of but choose to ignore, do not tell them who was driving !!
Reply telling them to either cancel the PCN or issue a popla code , so that popla can cancel it
If they don't , complain to the BPA and give them copies of all paperwork , due to a breach of the 2020 CoP3 -

They only need to get a NtK to the keeper within fourteen days if they want to transfer the driver's liability to the keeper, and then only if there was no windscreen ticket left on the vehicle at the time of the parking event.
Some parking companies, notably Smart Parking, do not bother to try to transfer that liability. They rely on the ignorance of most motorists and just send out rude speculative invoices and threats in the hope that the RK will know no better and simply pay whatever is demanded.5 -

Some of these people might post things on the internet, or spout their beliefs down the pub.
There is the law (the PoFA 2012), trade associations (old boys' clubs) and parking companies (scammers). Only one of the provides accurate information.

It's pointless arguing with Smart , they want that so you run down the clock
If an appeal is rejected , they should issue a popla code , so insist on cancellation or a popla code5 -

I'll try and request one from them, they have sent a no reply email with no further information so will maybe have to appeal again? Was it not an appeal rejection email?
A PoPLA verification code will be on that email.
